1. Agreement to Terms & Atelier Identification

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Client,” “you,” or “patron”) and ARTIFY DESIGN STUDIO & ATELIER S.P.A. (“we,” “us,” or “the Atelier”), concerning your access to and use of the artifydesign.com website, our digital boutiques, concierge services, and purchase of luxury goods.

By visiting our website or finalizing a purchase, you agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, you are expressly prohibited from using the platform and must discontinue use immediately.

2. Intellectual Property Rights & Trademark Protection

Unless otherwise indicated, the platform, digital media, timepiece designs, architectural garments, perfumery formulations, acoustic housings, text, graphics, logos, emblems, photography, lookbooks, video assets, and software code are the proprietary property of ARTIFY DESIGN and are protected by United States, European Union, and international copyright, trademark, trade dress, and patent laws.

3. Orders, Pricing, Currency & Authenticity Guarantees

All orders are subject to acceptance and availability. Because our timepieces and sartorial pieces are manufactured in limited handcrafted batches, placing an item in your digital cart does not guarantee allocation until payment authorization is complete.

4. Payment Processing & Anti-Fraud Verification

We accept major credit cards (Visa, MasterCard, American Express), Apple Pay, and authorized international wire transfers. You agree to provide current, complete, and accurate purchase and account information for all purchases made via our store.

• PCI-DSS Compliance: All credit card transactions are processed via tokenized, encrypted Level 1 PCI-compliant payment gateways.
• Security Screenings: For high-value timepiece and jewelry orders, our compliance team may request secondary identity verification prior to warehouse release.
• Sales Tax & VAT: Applicable domestic sales tax or value-added tax is calculated and displayed at checkout according to local statutory jurisdictions.

5. Worldwide Shipping, Delivery & Customs Duties

We partner exclusively with premium express couriers (DHL Express, FedEx, UPS) to provide fully insured global transit:

Customs & Duties (DDP): For major international regions, import customs duties and clearance fees are calculated and prepaid at checkout to avoid border delays.

6. 5-Year International Horology & Craft Warranty

Every mechanical timepiece and precision accessory bearing the ARTIFY DESIGN hallmark is warranted to the original patron against defects in materials and manufacturing for a period of five (5) years from the date of initial purchase.

7. User Accounts, Passwords & Client Conduct

When creating an account with ARTIFY DESIGN, you are responsible for maintaining the confidentiality of your login credentials and restricting unauthorized access to your devices. You agree not to engage in automated data scraping, denial of service attacks, or fraudulent dispute claims.

8. Limitation of Atelier Liability

In no event will ARTIFY DESIGN STUDIO & ATELIER, its directors, master craftsmen, affiliates, or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, or punitive damages arising from your use of the site or products. Our total liability for any claim shall not exceed the actual amount paid by you for the specific product giving rise to the claim.

9. Governing Law, Venue & Binding Arbitration

These Terms and Conditions and your use of the platform are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these terms shall be resolved through confidential, binding commercial arbitration administered under the rules of the American Arbitration Association (AAA).
